Welcome to Jobayer Hossan. These Terms of Service explain the conditions for using this website and working with me for website design, WordPress development, WooCommerce development, website fixes, and related digital services.
By using this website or hiring me for a project, you agree to the terms below.
1. Services
I provide website-related services including, but not limited to:
WordPress website development, WooCommerce development, Elementor website design, custom theme development, website fixes, website migration, performance improvements, CMS setup, ongoing support, and technical consultation.
The exact scope of each project will be discussed and agreed before work begins.
2. Project Scope
Each project is based on the agreed requirements, timeline, and price. Any additional work outside the original scope may require extra time and additional cost.
Examples of extra work may include new page designs, additional features, major layout changes, plugin customizations, extra revisions, content writing, product uploads, third-party integrations, or changes requested after approval.
3. Client Responsibilities
To complete the project properly, the client may need to provide required materials such as website access, hosting access, content, images, brand assets, plugin licenses, third-party account access, examples, and clear instructions.
Delays in providing required information or access may affect the project timeline.
4. Payments
Project pricing, payment terms, and milestones will be agreed before the project starts. For fixed-price projects, payment may be required upfront, in milestones, or after completion depending on the platform or agreement.
For hourly or ongoing work, billing will be based on the agreed hourly rate or support plan.
Work may be paused if payment is delayed or incomplete.
5. Revisions
Reasonable revisions are included when they are related to the agreed project scope. Revision requests should be clear and specific.
Major changes, new features, or changes outside the agreed scope may be treated as additional work.
6. Timelines
Estimated timelines are provided based on the project scope and available information. While I always aim to deliver on time, timelines may change due to delayed feedback, missing access, third-party issues, hosting problems, plugin conflicts, or additional client requests.
7. Website Content and Materials
The client is responsible for providing accurate text, images, videos, product information, legal pages, privacy policy content, and other website materials unless content creation is specifically included in the project scope.
The client must ensure they have the right to use any content, images, trademarks, or media provided for the project.
8. Third-Party Tools, Plugins, and Services
Some websites may use third-party plugins, themes, payment gateways, APIs, hosting, email services, booking tools, or other external platforms.
I am not responsible for issues caused by third-party services, plugin updates, licensing problems, server limitations, payment provider restrictions, API changes, or external platform downtime.
Any paid plugin, theme, hosting, or third-party subscription cost is the client’s responsibility unless agreed otherwise.
9. Website Maintenance
After project completion, ongoing maintenance is not included unless agreed separately. Websites may require regular updates, backups, security checks, plugin updates, bug fixes, and performance reviews.
I can provide ongoing WordPress or WooCommerce support if required.
10. Backups and Data
Before making changes to an existing website, it is strongly recommended to keep a full backup of the website files and database.
While I take care when working on websites, the client is responsible for maintaining proper backups unless backup service is included in the project.
11. Approval and Delivery
A project is considered complete once the agreed work has been delivered and the client has reviewed or approved the final result.
If the client does not respond within a reasonable time after delivery, the project may be considered completed based on the delivered scope.
12. Refunds and Cancellations
Refunds depend on the project status, work already completed, and the platform or agreement used for the project.
If work has already started or completed, full refunds may not be available. For cancelled projects, charges may apply for completed work, planning, communication, development time, or delivered files.
13. Portfolio Usage
Unless requested otherwise, I may showcase completed work in my portfolio, case studies, website, social media, or proposals. This may include the client’s website name, screenshot, project summary, and services provided.
If a project is confidential, the client should mention this before the project begins.
14. Intellectual Property
After full payment is completed, the client owns the final website content and custom work created specifically for their project, unless agreed otherwise.
Third-party plugins, themes, fonts, images, libraries, and tools remain subject to their own licenses.
15. Limitation of Liability
I aim to provide reliable and professional services, but I cannot guarantee that a website will always be error-free, uninterrupted, immune from security risks, or compatible with every future plugin, theme, browser, server, or platform update.
I am not responsible for indirect losses, business losses, revenue loss, data loss, search engine ranking changes, third-party service failures, or issues caused by changes made by others after delivery.
16. Communication
Project communication may take place through email, contact form, WhatsApp, Fiverr, Upwork, or other agreed communication channels.
Clear communication and timely feedback help keep the project on schedule.
17. Changes to These Terms
These Terms of Service may be updated from time to time. Any changes will be posted on this page with an updated date.
